Jury in Cosby's sexual assault trial resume deliberations

Bill Cosby jury to hear more of his deposition testimony

A jury in Norristown, Pa., is now deliberating for the second day in the trial of comedian Bill Cosby.

While the jury deliberated, Cosby publicist Andrew Wyatt released a statement from a Temple University student adviser who says Constand told her of a plan to falsely accuse a "high-profile person" of sexual assault so she could sue, get money and start a business.

79-year-old Bill Cosby is now being trialed for three counts of aggravated indecent assault.

The 12-member jury, havefailed to reach a verdict on Monday.

On Tuesday, jurors returned to court asking to hear again from Cosby's original deposition in the case from 2005.

The seven-man, five-woman panel subsequently returned to the deliberation room at around 10 am (1400 GMT) at Montgomery County Court in Norristown, Pennsylvania.

The jury returned to the Montgomery County Courthouse at 9 a.m. Tuesday, after deliberating for four hours Monday following closing arguments on the sixth day of the trial. He could face up to 10 years in prison for each charge. Bill Cosby is an easy target, able to stand in for all the men who might have mistreated us in a distant past, and a cautionary tale to those college frat boys who might take advantage when we lie supine and drunk on the floor in the future.

The defense has focused on inconsistencies in Constand's statements about the timing of the alleged assault, pointing out that she remained in contact with Cosby for weeks after the night in question.

The prosecution leaned on Cosby's words in the 2005 deposition, in which he admitted obtaining sedatives with a view to having sex.

Legal experts said testifying would have been a risky move that could have opened the TV star to withering cross-examination about some of the 60 or so other women who have accused him of drugging or molesting them. She testified the entertainer led her to a couch and she quickly became incapacitated and felt paralyzed as Cosby groped her breasts, inserted his finger in her and put her hand on his penis. They began deliberations on Monday and have been sequestered at a hotel for the trial's duration, a relatively rare occurrence in the US criminal justice system.

"He never shuts up", lawyer Brian McMonagle said of his client in closing arguments Monday morning.

Cosby is accused of drugging and sexually assaulting Constand, 44, and is charged with three counts of aggravated indecent assault, including allegedly assaulting an unconscious victim and allegedly delivering an intoxicant to a victim.

"She's on the phone with lawyers before she told her mom anything", he said, his voice rising regularly in agitation.

Constand initially told police about the alleged assault in January 2005, a year after she says it took place. Cosby testified over a decade ago as part of that lawsuit, eventually settling with her for an undisclosed sum.

According to the deposition, as he described reaching into Constand's trousers, Cosby testified, "I go into the area that is somewhere between permission and rejection".

He later told police the pills were Benadryl, a cold and allergy medicine, and that what transpired was consensual.

Her lawsuit against him had elicited four days of testimony from Cosby about his sexual conduct with some of them.

The trial wrapped late Monday after the defense team's six-minute case and both sides' closing arguments.

Prosecutors say his prior use of Quaaludes shows that Cosby had knowledge of what he was doing when he gave her the pills. She sat in the front row, across the aisle from Constand, who didn't react to McMonagle's two-hour closing but smiled at the end of it.

"We're here because of them", he said, pointing to the benches of reporters covering the trial.

Steele described Cosby as a calculating sexual predator who not only drugged and assaulted Constand more than a decade ago, but also cruelly recast the attack as consensual and romantic.
