Judges affirm 'Making a Murderer' confession was coerced

Ten years after Making a Murderer subject Brendan Dassey was sentenced to life in prison for the sexual assault, murder and mutilation of Teresa Halbach - along with his uncle, Steven Avery - a US appeals court has upheld a decision to overturn his conviction.

The state of Wisconsin have a 90-day window to have the case re-tried, or the case can be re-appealed as far as the U.S. Supreme court. The ruling came 10 years after Dassey was convicted of sexually assaulting and killing a 25-year-old photographer. "A Wisconsin Department of Justice spokesman said to the Milwaukee Journal-Sentinel, "[The state is] evaluating the 2-1 decision from the court. A United States #Federal Appeals Court upheld the decision made by a lower court Thursday, stating that Dassey's confession was not legitimate.

The case was the subject of the hit docu-series "Making a Murderer", a Netflix production that was released in December 2015.

In a joint statement, Brendan's legal team said: "We are overjoyed for Brendan and his family, and we look forward to working to secure his release from prison as soon as possible".

The center's director, Steven Drizin, said the ruling provides a model for the kind of thorough analysis that courts should always undertake in assessing whether a confession was voluntary, and highlights the importance for teenagers to have parents or trusted adults in the interrogation room.

"And this pattern continued until Dassey finally voiced what the investigators wanted him to say, seemingly guessing, or the investigators fed him the information they wanted".

They were on trial separately but were convicted of life for the crime.

Abrams: "The bottom line is, the only piece of evidence against Dassey is the confession. We continue to send our condolences to the Halbach family as they have to suffer through another attempt by Mr. Dassey to re-litigate his guilty verdict and sentence".

August 12, 2016: A judge throws out Dassey's conviction, ruling that investigators coerced a confession using deceptive tactics. Dassey's attorney, on the other hand, called it a "victory".

The court described the method used to get Dassey to confess as "death by a thousand cuts", with judge David Hamilton saying the decision "breaks new ground and poses troubling questions for police and prosecutors".

Zellner announced on Friday morning that she was traveling to visit Avery in prison and "tell him the good news" about Dassey. His uncle, Steven Avery, also is serving a life term in connection with the killing.

During one of the interviews, for example, Wisconsin Department of Justice Special Agent Tom Fassbender said: "Mark and I, yeah, we're cops, we're investigators and stuff like that, but I'm not right now".
