Charlottesville magistrate issues warrant for black victim of parking garage beating

Harris is the 20-year-old man who was seen being attacked by a group of white nationalists after crowds dispersed following the "Unite the Right" rally.

DeAndre Harris, who was severely beaten in August by white supremacists in Charlottesville, Virginia, has now been charged with the same crime as his attackers: "unlawful wounding".

The beating, which was captured on camera and quickly spiraled across the internet, occurred after a white supremacist tried to spear a counter-protester with a flag pole, the Washington Post reported in August.

Two other men are charged with malicious wounding for allegedly attacking Harris, according to local reports. A detective went to the magistrate and confirmed the victim's claims.

The police don't have sufficient probable cause to charge Harris, his lawyer said.

A video of the beating shows a group of approximately six people converging on Harris before clubbing him with wooden sticks, and kicking and stomping him inside a downtown parking garage last August.

One person involved in the brawl, who has not been identified by authorities, has now accused Harris of injuring him during the exchange.

A magistrate issued the warrant Monday.

Merritt added that the warrant is "highly unusual", saying that they are typically issued by the police department instead a magistrate.

Charlottesville police have charged two of Harris's attackers, but only after a national campaign demanded they do so.

Harris' head injuries were so severe that he required eight staples.

Merritt maintained his client did not instigate the fight and would turn himself in to police in the coming days. He also said he had cuts across his eyebrow, a chipped tooth and abrasions on his knees and elbows.
