The families' claims against Ikea fought that the maker reliably declined to meet intentional national wellbeing guidelines for security of chests and drawers. IKEA issued a statement to ABC saying "Our hearts go out to the affected family, and we offer our honest condolences during this most hard time". According to the Enquirer, he is the first child to die since IKEA issued a massive recall for chests and dressers, which can tip over and crush children if they aren't anchored to the wall.

Ikea recalled the three-drawer Malm and other models of chests and dressers in June 2016, citing a serious tip-over hazard, and urged customers who'd purchased the dressers to either anchor them to a wall, or return them for a refund.

Nancy Cowles, executive director of the non-profit Kids In Danger, believes Ikea needs to be doing more to reach out to parents with these dressers. At the time they offered a full refund for any pieces manufactured between 2002 and 2016, or a free fix kit that included a wall anchor to prevent the tall items from tipping.

Ikea did not address the validity of these numbers, but they did note in their statement that the recall of Malm dressers goes back many years, and argued that it would be impossible to truly know how numerous items are still now being used. Seventeen of these resulted in injuries of children between 19 months and 10 years old.

The safety agency said it was investigating. Ikea added that it has "worked hard to make participation in the recall as easy as possible for consumers".

The previous lawsuits against IKEA asserted that the unsafe design of the dressers rendered them inherently unstable and easily tipped over. Consumers with chests and dressers manufactured prior to January 2002 will be eligible for a partial store credit.

According to the CPSC, one child dies every two weeks and a child is injured every 24 minutes in the United States from furniture or TVs tipping over on them.
