But according to Vanity Fair, de la Huerta has been in communication with the New York Police Department, and detective Nicholas DiGaudio told the publication, "I believe based on my interviews with Paz that from the N.Y.P.D. standpoint we have enough to make an arrest".

"If this person were still in NY, and it was recent, we would go right away and make the arrest, no doubt", Boyce said. "We then sought to garner corroboration. and we found it, corroboration", Chief Boyce said.

"We have an actual case here", he added. But we're talking about a seven-year-old case.

Boyce's remarks came not long after Paz de la Huerta, the "Boardwalk Empire" actress, told Vanity Fair that Weinstein raped her twice during separate encounters in 2010. That's when she alleges Weinstein took off her dress and forced himself on her.

The second assault happened just a month later in December she says. She had been drinking and was not in a condition to give consent, CBS reported the actress said.

Disgraced movie mogul Harvey Weinstein donned a wig, baseball cap and orange make-up in an effort to go incognito for a meal out in Phoenix, Arizona on Thursday night.

Evidence against Weinstein may be delivered to a judge, in order for police to obtain an arrest warrant, or the evidence could go to a grand jury, if police decide to pursue an indictment.

She joins dozens of women who have already leveled allegations of sexual abuse against Weinstein.

"We are aware of the sexual assault complaints".

Weinstein has not commented on the latest accusation but has repeatedly denied allegations of non-consensual sex.

"A senior sex crimes prosecutor is assigned to this investigation, and the Office has been working with our partners in the NYPD since the new allegations came to light".
