Woman jailed after eviction gets released ahead of 94th birthday

In the bodycam footage the 93-year-old can be heard crying out for officers not to hurt her

A 94-year-old woman was handcuffed and thrown in jail after she refused to leave her care home in Lake County, Florida.

Fitzgerald was placed in a Eustis patrol vehicle Tuesday after repeatedly refusing to leave the lobby of Franklin House.

"Unless you carry me out of here, I'm not going anywhere", she reportedly told officers.

According to an arrest report, while officers tried to escort her out of the building, she purposely slid onto the floor and resisted when they tried to pick her up.

Fitzgerald was charged with trespassing.

Ms Fitzgerald was spared having to spend her 94th birthday behind bars after a judge handed her over to a caregiver on Thursday.

Fitzgerald was released from jail Thursday and is staying with a friend until her December 27 court appearance. Her birthday was on Friday.

She was handcuffed and chained in her wheelchair while being interviewed, as seen in the video below, by local news outlet CBS's WKMG. Karen Twinem, of National Church Residences, which owns the facility, told WKMG that Fitzgerald refused to pay, because she thought would die soon.

She said she couldn't understand why she was being evicted, but court records show she owed rent and would not pay.

"Juanita Fitzgerald was made well aware the day prior of her being evicted today", according to the police report. They said: 'We tried to convince her'.

"This is extremely rare", said Twinem, who said National Church Residences runs 340 properties. She also said she refused help from the Franklin House to find her another home and she refused help from her own family. I don't need no help. "My family is in Tennessee and I told them not to tell my son anything that's going on", she said.

"I feel like everything was done that could possibly be done to help her". Asked about why she would not pay the rent, the woman, who was handcuffed and appeared to have bruises up her arms, said of a housing facility employee: "She wouldn't take it, that woman blamed me for the mould".

She is now staying in a Tavares hotel room, which is being paid for with donations.
