Kenyan opposition politician charged over mock inauguration

Odinga claims he, not President Uhuru Kenyatta, is the real victor of a presidential election held in August but later nullified by the Supreme Court on procedural grounds.

A Kenyan opposition politician was charged with treason on Tuesday over the symbolic presidential "swearing in" of opposition leader Raila Odinga, reigniting street protests in which one person was killed.

Two other opposition lawmakers were also arrested and later released for their involvement in the ceremony.

He was charged with "being present and consenting to the administration of an oath to commit a capital offence, namely treason", says the charge sheet quoted by Reuters. In Nairobi, High Court judge Luka Kimaru ordered that Miguna be released.

The Milimani Law courts was packed with the attendance of the Nasa leader Raila Odinga and several lawyers representing Miguna led by senior Counsel John Khaminwa.

"As soon as we serve the order this morning I expect the stations to be back on", he said.

The government ignored a court order issued on Thursday to restore the stations, prompting activist Okiya Omtatah to file a case seeking the arrest of officials for contempt of court on Monday. His supporters in the opposition stronghold of Kisumu city in western Kenya clashed with police, who fired tear gas at them.

Witness Carlos Ouma said a county revenue collector was killed by a stray bullet after police fired into the air to disperse demonstrators in nearby Ahero, Miguna's home town.

The government suspended the passports of 14 opposition leaders including strategist David Ndii and financier Maina Wanjigi. Mr Odinga boycotted a re-run election in October, saying no reforms had been made to the electoral commission.

The government took three private television channels off the air on Tuesday as they began to cover of the opposition ceremony.

The Judge was furious by the Government's actions of not following the court orders as enshrined in the constitution by not charging a suspect within 24 hours after being arrested.
