Andrea Constand Testifies Agreeing to $3.38M Settlement With Cosby Because She 'Just Wanted It Over'

"Never asleep nor awake", responded the now-80-year-old, who has been accused of drugging and sexually assaulting some 60 women in all.

Cosby, who has denied all allegations against him, claimed in a statement to investigators in 2005 that he gave Andrea Constand, the accuser at the center of the retrial, over-the-counter allergy medication the night she alleges that she was drugged and raped in his suburban Philly home in 2004.

"When you got the Quaaludes, was it in your mind that you were going to use these Quaaludes for young women that you wanted to have sex with?" asked Constand's then-attorney Dolores Troiani.

On Monday (Tuesday NZT), Constand rejected defence allegations that she concocted her story to score a big payday, and her mother testified that Cosby apologised in a phone call and called himself a "sick man".

Constand explained that she may have been mistaken, that there were times Cosby told her in advance that the gate would be open and that she often reached him at another number. The hearing dealt with attorney-client privilege, Fifth Amendment concerns and Cosby's defense team's plans to call one of Constand's civil attorneys to the stand, as well as a toxicologist who will dispute her account of how the drugs affected her.

The new jury yesterday heard testimony from Cheltenham Township police who initially investigated the case shortly after accusations by Constand, a former director of operations for the women's basketball team at Cosby's alma mater, Temple University. She told the jury she wanted it to stop, but was unable to speak or fight him off.

There, he said he got prescriptions for Quaaludes from his doctor for a sore back, but never took them. "And I don't feel her say anything", he said in the deposition.

She described accepting pills from Cosby that he said would help her "relax", and then losing control of her body and emerging from a stupor to Cosby spooning her rigid frame and sexually assaulting her.

At last year's trial, Cosby's lawyers suggested that Constand and the former "Cosby Show" star were lovers who had been intimate with each other in the past.

As Cosby arrived at the courthouse Tuesday, his spokeswoman, Ebonee Benson, told reporters that Constand's testimony "seemed to be more colorful and more embellished" than at the first trial. She said Cosby touched her breasts and vagina and used her hand to stroke his penis while she was incapacitated. It was read into the record at Cosby's first trial previous year, which ended with a hung jury. Cosby lawyer Tom Mesereau previously had asked her about the Valentine's Day calls and mentioned them in his opening statement.

Attorneys also battled over Cosby and Constand's phone records.

Second trial: Constand testified she doesn't "recall ever having a conversation with" Jackson. This time around they're expected to at least call Marguerite Jackson, Constand's colleague at Temple, and have been attempting to compel to testify Sherri Williams, a friend of Constand's. The testimony was also included at his first trial, which ended with a hung jury previous year. At the time, Judge Steven O'Neill ruled Jackson's testimony would be hearsay.

Andrea and Gianna Constand's testimony followed that of five additional accusers who told jurors that Cosby drugged and assaulted them two decades earlier.

Cosby is on trial over charges he drugged and molested Constand in 2004.
