Impeachment petition listed before five-judge bench

Two Congress MP move SC against VP Naidu rejecting CJI Misra's impeachment motion

A five-Judge Constitution Bench of the Supreme Court will hear on Tuesday a plea by two Congress Rajya Sabha members against house Chairman M Venkaiah Naidu's decision to reject a notice on the impeachment motion against apex court's Chief Justice Dipak Misra.

On 23 April, Naidu, Vice-President of India and Chairman of the Rajya Sabha, had rejected the impeachment motion, holding it was "neither legal nor desirable or proper" to admit it.

The matter was mentioned before a bench headed by Justice J.S. Chelameswar, who did not pass an order and asked the parties to come on Tuesday.

Justice Kaul asked Sibal, who has drafted the petition, whether the plea had been numbered.Sibal replied that they have filed a petition in the Registry but they are not willing to number it."The procedure of this court is very simple". Faced with Justice Chelameswar's initial reluctance, Sibal said, "I am aware that the CJI is the master of roster and that petitions need to be mentioned before him for urgent listing. All I am asking Justice Chelameswar to consider this", Sibal said. Justice Sikri is judge number six in the Supreme Court.

Earlier, over 70 MPs of the Rajya Sabha belonging to seven political parties gave the notice for the impeachment against the CJI.

The two leaders who have moved the petition are Congress' Rajya Sabha MPs Pratap Singh Bajwa, who is from Punjab, and Amee Harshadray Yajnik, who is from Gujarat. Sibal had said that this writ could not be mentioned anywhere else.

Sub-Section 1 of Section 3 of the Judges Inquiry Act says: "The Speaker or, as the case may be, the Chairman may, after consulting such persons, if any, as he thinks fit and after considering such materials, if any, as may be available to him, either admit the motion or refuse to admit the same". These included the assigning of sensitive cases to handpicked Judges, which was raised publicly in January by four top Judges who accused the CJI of abusing his position as "master of the roster".

Reportedly, Justice Chelameswar had said he would take a call on Tuesday on whether he should decide about listing of the petition but a bench to hear the case has been formed before he could make a decision. "The Chairman can not sit and adjudicate over the adequacy, veracity and legal tenability of the allegations/charges contained in the said Notice".

It sought setting aside of the chairman's order terming the charges contained in the notice of motion are "extremely serious" and merit "a full-fledged inquiry to test their veracity".
