Collegium judges meet CJI Dipak Misra, discuss Justice Joseph's elevation

In 2017, Justice Chelameswar had described Justice Joseph as "an outstanding and a highly competent judge" and recorded a dissenting note and objected to his non-elevation to the Supreme Court.

Justice Chelameswar was the senior most among the four judges who held the unprecedented press meet on January 12, where they had voiced concern about the "administration of justice" and selective allocation of cases by recent Chief Justices, including Chief Justice Misra, to preferred Benches in the Supreme Court. However, since the petition by the Congress MPs involved Justice Misra himself, a collective decision of the collegium in constituting the bench would have nipped in the bud the current controversy, some legal luminaries said.

Just-Ice Chelameswar's letter, say resources, is really a rebuttal of those details that regulation Minister Ravi Shankar Prasad has made while advocating that the judges to reconsider the promotion of Justice Joseph - that the primary prosecution of the Uttarakhand highcourt - to the Supreme Court. That can only happen once the Chief Justice convenes a formal meeting of the Collegium and places that on the agenda.

While rejecting outright the claims of Prasad, Justice Chelameswar has said that the Collegium should not back down from its recommendations. It also said he was from Kerala, which is already represented, and that that there were no judges from Dalit backgrounds.

SCBA honorary secretary Vikrant Yadav said the senior most judge today met the members of the bar at his residence, had a chat with them but declined the invite for his farewell.

If the collegium sends back a name, the Centre has no choice but to accept it. He had declined to participate in his own farewell when he was transferred from Andhra Pradesh High Court as the Chief Justice of Guwahati High Court.
