Former police officer charged with the murder of St. Lucian national

Dallas County court records show that a white former Dallas police officer has been indicted on a murder charge for the killing of her black unarmed neighbor when she says she mistakenly went to his apartment instead of her own and shot him.

Amber Guyger, shot and killed 26-year-old Botham Jean, after claiming that she got off the wrong floor and went to Jean's apartment by mistake. But Johnson said at the time that the grand jury could upgrade the charges, which it did Friday.

"The Jean family's loss can not be restored to them, but we will continue to work to ensure that police officers are held to the same standards as everyone else in the Dallas community and across the state of Texas", she said.

Guyger lived in Apartment 1378 of the South Side Flats complex close to Dallas Police headquarters, according to Guyger's arrest warrant affidavit, as cited by Dallas Observer. She put her key in the lock, and the door, which was slightly ajar, opened. When she opened the door, she saw the interior was nearly completely dark, according to the affidavit. She turned on the lights while on the phone with 911, and only when asked for her address did she realize she was in the wrong apartment, she told police. She was sacked weeks later by the Dallas Police Department. She has since been fired from the department and Jean's family has filed a lawsuit against Guyger and the city of Dallas.

The Dallas police chief has said she doesn't know if race was a factor in the man's death.

"When you look at the facts of this case, we thought that it was murder all along", Johnson said.

Defense attorney and former Dallas County prosecutor Pete Schulte told the Observer earlier this week that the grand jury was more likely to indict Guyger for murder than manslaughter, if it indicted her at all, because she meant to shoot Jean.

Dallas County DA Faith Johnson said her office spoke to over 300 witnesses, did lab testing and presented it to the grand jury this week after months of work.

On Sept. 9, she was arrested on a manslaughter charge and immediately bailed out.

Speaking at a news conference Friday, Allison Jean said she believed Guyger "inflicted tremendous evil on my son".

Her office, Johnson said, took its time before seeking an indictment in the case to ensure that it could paint the best possible picture of the shooting to the grand jury. A manslaughter charge would have brought a sentence of up to 20 years.

Robert Rogers, an attorney for Guyger, said in a statement in September, "What happened on Sept. 6 was a tragic mistake and words can never express our sorrow for the pain being suffered by those who knew and loved Botham Jean".

Guyger has since been fired from the department and Jean's family has filed a lawsuit against Guyger and the city of Dallas. After graduating from college in Arkansas, he moved to Dallas to work for PriceWaterHouseCoopers.
