Border Patrol Officers to Be Trained in Conducting Asylum Interviews

Border Protection Acting Commissioner Kevin Mc Aleenan speaks during a press conference in Washington D.C. Jan. 31 2017

The testing will happen after U.S. Customs and Border Protection officials refer possible instances of fraud to ICE.

Many immigrant advocates are coming down on the new proposed regulations that will only make it harder to those seeking asylum.

. ICE would handle only those immigrants whose claims seem to fit the United States' official requirements for granting asylum.

House Appropriations Committee Chairwoman Nita Lowey, a New York Democrat, said Trump's administration had contributed to the crisis on the border and her committee would be taking a thorough look at the request.

Numerous children seeking US asylum come from Central American countries plagued by high murder rates, gang activity and illicit drug trade.

Customs and Border Protection told NBC News that from October 1 to March 30 it identified more than 2,700 individuals on the southwest border that falsely claimed to be part of a family unit with unaccompanied children.

The Rapid DNA testing, as it's known, involves a cheek swab and can, on average, provide results in about 90 minutes, a senior Immigration and Customs Enforcement official said.

For comparison, the application fee for the Deferred Action for Childhood Arrivals (DACA) program is $495, the fee for green card holders to file for U.S. citizenship is $725, and the fee to apply for a green card can go as high as $1,225, according to U.S. Citizenship and Immigration Services.

Trump Announces New Tariffs On China And They're YUGE
Trump repeated a threat to raise the rate on existing tariffs and tax almost all of China's exports to the United States. It now has imposed 10% tariffs on $200 billion in Chinese imports and 25% tariffs on another $50 billion.

The first step in the long USA asylum process is an interview by a USCIS official specially trained in asylum and refugee law to determine whether a migrant has a "credible fear" of returning to their home country. That's understandable given the current conditions in Central America but it's not grounds for asylum.

The White House is seeking $23 million of funding to train border patrol agents to perform "credible fear" interviews that are usually done by specialized USCIS asylum officers. He is one of many asylum seekers that would be affected by the new proposal as he is fleeing political persecution. Ashley Tabaddor, president of the immigration judges' union, told Reuters, "The provision to process cases in 180 days has been on the books for over two decades".

The Trump administration has said people are gaming the legal system in order to stay in the country. That means they can search a US citizen's devices to probe whether that person's family or friends may be undocumented; the devices of a journalist or scholar with foreign sources who may be of interest to the USA government; or the devices of a traveler who is the business partner or colleague of someone under investigation. That policy is being challenged by lawsuits.

ICE's Enforcement and Removal Operations has also temporarily shifted approximately 330 deportation officers to areas at or near the border or to areas within the U.S. most impacted by surge of migrants at the border.

This memo calls for authorities to adjudicate asylum claims in Immigration Court proceedings within 180 days of filing.

Moreover, restricting access to work permits will discourage the abuse of the asylum process by migrants who simply want to take advantage of the superior economic opportunities that the United States offers, freeing up resources for processing those who have legitimate claims to access our generous asylum protections.
