The National Highway Transportation Safety Association has taken Tesla to task, sending the electric carmaker a cease-and-desist letter regarding Tesla's claims about the federal agency's safety rating of the Model 3 sedan. According to the documents obtained by PlainSite, the NHTSA is also sent Tesla a subpoena as part of the agency's protocol in order to obtain information about crashes wherein Tesla cars are involved.

This past fall, Tesla touted the safety rating of the Model 3, saying that NHTSA's tests showed the auto had "the lowest probability of injury of all cars the safety agency has ever tested".

Now, in an odd turn of events that will perhaps not surprise longtime Tesla detractors, PlainSite recently discovered that the NHTSA previous year hit Tesla with a cease-and-desist letter claiming that the company's safety claims regarding the Model 3 are misleading.

That's why this time around the NHTSA is planning to report Tesla to the Federal Trade Commission's Beaurau of Consumer Protection to clear the issue once and for all.

Tesla reportedly responded to NHTSA, saying in a letter dated October 31 that it respectfully disagreed with the government agency. In a response letter, Tesla insisted on following NHTSA's guidelines in publishing overall safety ratings in advertising Tesla Model 3.

Tesla, meanwhile, maintains that its information regarding injury probability is based on "sound public data" and that it does not "contravene NHTSA's guidelines".

Tesla says Model 3 tenants have the moderate possibility of the affliction of all cars the security agency has ever scrutinized. Regarding NHTSA's reasoning that the car's weight is an important factor in determining the risk of injury, Tesla said that no claim has been made from their side that Tesla Model 3 will outperform any heavier vehicle. But NHTSA took issue with Musk and Tesla's claims that it also achieved the "lowest probability of injury of any vehicle ever tested" and other similar public statements.

The NHTSA conducts a number of different crash tests for each vehicle and then issues a series of ratings ranging from one to five stars for different aspects of vehicle safety.

Tesla's electric vehicles are best known for its high-tech features such as its autopilot system.

Technically Tesla is a safe vehicle because it scored flawlessly in all the tests conducted by the NHTSA.

The letter got noticed this week after a tradeoff of letters and email between NHTSA and Tesla officials commencing last October and operating through February of this year was tacked up on Plain site a legal transparency website.
